Mr. Gesser is a member of Davis Polk & Wardwell’s Litigation Department. He represents clients in a wide range of securities enforcement and white-collar criminal defense matters, class actions and complex commercial cases. Currently, he is representing a major investment bank in class actions involving analyst independence issues. Mr. Gesser also recently served as a lead negotiator of a multi-year comprehensive agreement between a large consumer products company and multiple governmental bodies related to international trade issues. He represented corporations and individuals in various investigations that have been resolved favorably prior to trial (either because charges were not pursued or because no action was taken at the conclusion of the investigation), including the New York Racing Association, which entered into a deferred prosecution agreement with the United States Attorney’s Office for the Eastern District of New York following a three-year investigation. Mr. Gesser was also part of the litigation team that represented Delta Air Lines in its Chapter 11 restructuring.
He joined Davis Polk in 1998 and returned to the firm in 2000 following his clerkship. He became a partner in 2007.
Mr. Gesser graduated, with highest honors, from the University of Manitoba (Canada) (B.Sc., 1991; LL.B., 1994). He also received an LL.M. from Cambridge University in 1995 and in 1998 received an LL.M. from New York University School of Law, where he was a graduate editor of the Journal of International Law and Politics. He clerked for the Honorable I. Leo Glasser, U.S. District Court, Eastern District of New York, from 1999 to 2000. He is admitted to the bars of Manitoba (Canada) and New York, the U.S. District Courts for the Eastern and Southern Districts of New York and the First, Second, and Fifth Circuit Courts of Appeals.
