Mr. Carroll is a member of Davis Polk & Wardwell’s Litigation Department. He has represented a wide range of clients in federal and state jury trials, and in government investigations and administrative trials.
His recent trials include Oracle v. PeopleSoft (Delaware Chancery Court) (represented Oracle in its successful acquisition of PeopleSoft, which followed a two-week trial challenging a poison pill and other takeover defenses); The Common Fund v. KPMG (S.D.N.Y. 2000) (jury verdict for client/defendant named verdict of the year by The National Law Journal); In the Matter of KPMG Peat Marwick (SEC enforcement action); Haft v. Haft (jury verdict and bench order for client/plaintiff, including property award of more than $50 million and punitive damages of $8 million). He also defends corporations and boards of directors in federal and state class-action litigation. His recent matters include the Clear Channel and Tyco litigations. His work also includes confidential internal investigations on behalf of corporations facing potential criminal and regulatory exposure.
Mr. Carroll joined Davis Polk in 1983 and became a partner in 1989.
Mr. Carroll graduated from Dartmouth College, with distinction, in 1978 and in 1982 received his J.D. from Columbia Law School, where he was an editor of the law review and a Harlan Fiske Stone Scholar. He clerked for the Honorable Walter J. Cummings, Chief Judge, U.S. Court of Appeals, Seventh Circuit, from 1982 to 1983. Mr. Carroll teaches trial and litigation courses for PLI and New York City Bar programs.
