Scott W. Muller


Mr. Muller is a member of Davis Polk & Wardwell’s Litigation Department and focuses on global compliance, SEC, white collar criminal and complex civil and regulatory investigations and enforcement matters. From October 2002 through July 2004, Mr. Muller served as General Counsel of the Central Intelligence Agency and from 1979 to 1982, he served as an Assistant U.S. Attorney for the Southern District of New York.

Mr. Muller pioneered the use of the corporate “deferred prosecution” to resolve a federal criminal investigation. Mr. Muller has handled numerous internal investigations and has represented and advised financial and industrial companies on issues relating to, among other things, money laundering, the Foreign Corrupt Practices Act and financial reporting, insider trading, securities, tax, antitrust and environmental issues. His litigated matters have included law firms and accounting firms in accounting and professional liability matters; Texaco in civil, criminal and derivative matters relating to a civil rights matter; Roche Holdings in criminal and civil antitrust proceedings relating to the vitamins industry; Prudential Securities and Prudential Insurance in numerous matters relating to the sale of over $3 billion in real estate, oil and gas and other limited partnerships; and Warner Lambert (now owned by Pfizer) in various investigations relating to drug marketing and environmental compliance.

Mr. Muller joined Davis Polk in 1976, returned to the firm in 1982 following his public service as Assistant U.S. Attorney, and became a partner in 1985. He also clerked for the Watergate Special Prosecution Force and for the Honorable Francis L. Van Dusen, U.S. Court of Appeals, Third Circuit.

He graduated from Princeton University in 1971 and in 1975 received his J.D. from Georgetown University Law Center, where he served as case and notes editor of the Georgetown Law Journal.

Mr. Muller is a member of the American Law Institute, is a former vice chairman of the White Collar Crime Committee of the American Bar Association, and was an adjunct professor at Georgetown University Law Center, where he taught a seminar in internal investigations and the federal criminal process.

He is a former member of the board of governors of St. Albans School in Washington, D.C., and of the audit committee of the National Cathedral Foundation. He has served on the board of trustees of St. Paul’s School and as chairman of its Alumni Fund. He is a past national trustee of the Boys and Girl’s Clubs of America and, from 1998 to 2002, served as chairman of the board of The Center for the Community Interest. He has been an instructor for the National Institute for Trial Advocacy and a panelist at Practicing Law Institute seminars.
