Guy Miller Struve


Mr. Struve, a member of Davis Polk & Wardwell’s Litigation Department, represents clients in trials, appeals and other litigation in antitrust, bankruptcy, commercial, criminal, derivative, employment, intellectual property, liability insurance, mergers and acquisitions, products liability, professional liability, regulatory, RICO, securities, tax and other areas of the law. Among the industries in which he has represented clients are energy, insurance, publishing, shipping, sports and telecommunications.

His major recent matters include representations of Altria, Consolidated Edison and other clients in litigated and other matters, as well as clients in bankruptcy proceedings.

Mr. Struve’s publications include “Economic Evidence and Economic Experts in Antitrust Litigation” and “Defending Against a Government Motion for a Preliminary Injunction: A Case Study,” in 2 Antitrust Counseling and Litigation Techniques (ed. J.O. von Kalinowski, 1984), and “Antitrust Laws and Procedures Applicable to Mergers and Acquisitions,” CCH Business Strategies Reporter (1984).

Mr. Struve joined Davis Polk in 1967 and became a partner in 1973.

Mr. Struve graduated from Yale University, summa cum laude, in 1963 and in 1966 received his LL.B., magna cum laude, from Harvard Law School, where he was a member of the law review. He clerked for the Honorable J. Edward Lumbard, U.S. Court of Appeals, Second Circuit, from 1966 to 1967. From 1987 to 1994 he was a part-time associate counsel in the Office of Independent Counsel Lawrence E. Walsh.

Mr. Struve chairs the Committee on Civil Litigation of the United States District Court for the Eastern District of New York and is co-chair of the Advisory Group to the New York State-Federal Judicial Council. He is a past co-chair of the Joint Committee on Local Rules of the United States District Courts for the Southern and Eastern Districts of New York. He also is a member of the American Law Institute, the American Bar Association, the American Bar Foundation, the Federal Bar Council, the New York State Bar Association and the New York City Bar Association, where he chaired the Committee on Antitrust and Trade Regulation from 1983 to 1986, and the Committee on Federal Courts from 1998 to 2001.
