Most recently, Davis Polk represented the largest defendant in the vitamins price-fixing cases—which have proceeded in a variety of federal and state jurisdictions. Davis Polk has also represented both plaintiffs and defendants in cases alleging predatory or exclusionary behavior, such as tying, monopolization and patent misuse.

• We are representing AstraZeneca in class actions and multi-district proceedings relating to pharmaceuticals pricing.
• Our antitrust practice group has successfully represented numerous parties in government antitrust investigations of proposed mergers and acquisitions before the Department of Justice and the Federal Trade Commission, including Comcast, Sallie Mae, McDATA, KLA-Tencor, Roche, AstraZeneca and First Group Plc.
• We successfully defended AstraZeneca in a multi-district antitrust class action lawsuit challenging the settlement of a patent lawsuit regarding the cancer drug Tamoxifen. The case was dismissed by the district court, affirmed by the Second Circuit and certiorari was denied by the U.S. Supreme Court.
• We secured the dismissal of an antitrust action brought by The America Channel (TAC) claiming that our client Comcast and its co-defendant Time Warner illegally conspired to refuse to deal with TAC.
• We have represented clients in government grand jury investigations and private litigations arising out of alleged price-fixing cartels in various industries, including copper tubing, prescription drugs, magnetic tape, explosives, insurance forms and software, auction services, NASDAQ trading and securities underwriting.
• We are representing Morgan Stanley and acting as liaison counsel for the defense group in an antitrust class action alleging a price-fixing conspiracy to set inflated borrowing rates for “hard to borrow” securities in connection with short sales by prime brokerage customers.
• We defeated class certification in connection with our ongoing representation of Morgan Stanley and serving as the liaison counsel for the defense group in cases that allege that some 20 underwriters had conspired since 1994 to fix the fees charged in certain IPOs at 7% of gross proceeds.
• We are representing Hoffmann-La Roche in civil and criminal antitrust proceedings in connection with alleged worldwide vitamin price-fixing
